Florida Car Crashes
Anytime a pedestrian is killed in a car accident, several things have to be done right and be done quickly if the family is going to solicit financial compensation for their wrongful death. Due to Florida’s no-fault auto insurance laws, a claim cannot be immediately brought against the person responsible for the accident.
Before the claim can be filed, evidence that proves the driver’s liability needs to be gathered. This is usually done by re-creating the accident scene, securing statements from eyewitnesses, reviewing the driving record of the at-fault driver, and analyzing footage from traffic cameras if there are any.
Florida allows its residents a very brief statute of limitations. Once that has passed, you will no longer be able to submit a wrongful death claim. This means that you must get in touch with a Florida wrongful death attorney as soon as you can do so.
If you recently lost a loved one to wrongful death in Florida, the law entitles the personal representative of their estate, typically a surviving parent, child, or spouse, to file a wrongful death suit in state court for financial compensation for monetary damages.
